Please could you tell me how many checks on Motorcycle noise Cheshire police have carried out in each of the last five years, and how many prosecutions there have been in each of the last five years against motorcycle exhausts which do not conform to the Road Vehicles (Construction and Use) Regulations 1986.

In accordance with section 1(1) (b) of the Act our response is provided below;

The first part of your question, 'How many checks have been carried out on motorcycle noise'

This is not possible to answer within the limits of FOI as information would be recorded in individual officers note books. To canvass each individual officer and examine each pocket note book for a five year period would, it is estimated, exceed the appropriate limit. The appropriate limit is defined in the Data Protection and Freedom of Information (Fees and Appropriate Limit) Regulations 2004, which is covered by statutory Instrument Number 3244 of 2004. Furthermore, section 12 of the Freedom of Information Act 2000 allows a public authority to refuse to respond to a request for information where the cost of compliance would exceed the appropriate limit as defined by the above mentioned regulations.

There is no information currently available of any 'organised campaigns' or local initiatives relating to this matter.

Four offences were dealt with by Fixed Penalty Notices and one (2003) by way of summons.
