In accordance with section 1(1) (b) of the Act our response is provided below;

Question 1

There is no information held. The Cheshire Constabulary does not run an auction or sale scheme to dispose of recovered goods and property. Property is periodically disposed of through public auctions run by auction houses and we deal with them the same as any other member of the public does.

The relevant legislation which covers this process is The Police ( Property ) Regulations 1997 made under section 2 of the Police ( Property) Act 1897 as extended by section 43 (5) of the Powers of Criminal Courts Act 1973 and as amended by section 1 of the Police (Property) Act 1997. The Regulations come into force on 1 September 1997 and replace the Police (Disposal of Property) Regulations 1975.
