In respect of Question 6.

I have now considered this question and I am not obliged to supply the information requested.

Section 17 of the Freedom of Information Act 2000 requires the Cheshire Constabulary, when refusing to provide such information (because the information is exempt) to provide you with a notice which a) states that fact, b) specifies the exemption in question and c) states (if that would not otherwise be apparent) why the exemption applies.

The information is exempt information in accordance with section 31 (1) (a) (b) Law Enforcement

Harm in disclosure

Release of the details of what data can be accessed from these devices could encourage a technical attack on their connectivity, especially when it could be linked to the disclosure of any information on question 5 which would identify the bearer device. For example, if it is published that PNC is available on mobile devices transmitting over a Vodafone GPRS network that could conceivable focus an attack.

The Public Interest Test

For

The public may feel reassured that the Police have more up to date information to hand which will help apprehend offenders. Accountability of public funds will also be a consideration. Better awareness of police capability may reduce crime or lead to more information from the public.

Against

Law enforcement tactics could be compromised which would hinder the prevention and detection of crime. It could also undermine the partnership approach to sharing information if it was found that the technical capabilities and weaknesses were exposed.

Balance

To disclose such a detailed amount of information could expose weaknesses within tactical capability. Therefore favour falls in withholding this information.
