Request
How many homes have mistakenly been broken into during
police raids in 2007, 2008, 2009 and so far in 2010?
For each could you please indicate the method of entering the
property (broke down the door/ smashed window etc) and what the
cost of repairing the damage/compensation was.
Response
In accordance with section 1(1) (a) of the Act our
response is provided below;
I am unable to confirm whether or not we hold the
information you have requested. In order to ascertain if we do in
fact hold such information would require a manual search of all
person records and links to addresses and/or intelligence
information. In addition a search of claims made for compensation
for the last three years to see if any were successful or whether
any such claims were settled informally. This it is estimated would
exceed the appropriate limit. The appropriate limit is defined in
the Data Protection and Freedom of Information (Fees and
Appropriate Limit) Regulations 2004, which is covered by statutory
Instrument Number 3244 of 2004. Furthermore, Section 12 of the
Freedom of Information Act 2000 allows a public authority to refuse
to respond to a request for information where the cost of
compliance would exceed the appropriate limit as defined by the
above mentioned regulations.
I can add from previous similar requests that no compensation
has been paid specifically because the wrong address was subject of
a police raid and as far as is generally known there is no
anecdotal information to suggest that such an event has occurred.
Unfortunately we cannot confirm this as fact within the FOI cost
limits.
