Arrest and Sickness Absence

Request

1. Copies of all documents/forms currently produced by the force for the purpose of being completed by personnel in relation to an arrest. Please include all types of form or document that can be filled in, in relation to an arrest, even if making a record of the arrest is not the main purpose. Please include hardcopy documents, and those completed digitally. These can be 'blank' forms, ie with no information inputted, and any confidential or sensitive information can be redacted.

Please include all types of form or document that can be filled in, in relation to sickness, even if making a record of the sickness is not the main purpose. Please include hardcopy documents, and those completed digitally. These can be 'blank' forms, ie with no information inputted, and any confidential or sensitive information can be redacted.

Response

In accordance with section 1(1) (b) of the Act our response is provided below;

Question 1: We have interpreted this question literally and as such there is one form that requires completion following an arrest. The form is the custody record and is completed by the custody sergeant with input from the arresting officer and the detainee. Within Cheshire Constabulary this form is held electronically and completed digitally. We are unable to provide a copy as blank forms cannot be printed. However, I can confirm that the information we hold on the custody record is as follows:

Circumstances of arrest and offence details

Time and place of arrest

Personal details e.g. name, address, date of birth etc.

Risk assessment

Property details

Details of when their rights were given and which were exercised

Hospital details (if they attend hospital)

Disposal details

Release details

Detention log detailing activity following arrest

Medical care

In addition to the above if the detainee is a young person or vulnerable adult the arresting officer is required to complete a referral/notification form, (referred to as a Form 40a) to the Public Protection Unit. This again is an electronically held form completed digitally . The information it contains is as follows:

Personal details, e.g. name, address, date of birth etc.

The reason for the referral

The observations of the officer.

Any other documentation is entirely dependant on the offence(s) the person was arrested for. The basic details to record the arrest and populate other systems such as the PNC is achieved electronically from the custody record which is part of an electronic records management system. Fingerprinting is achieved electronically through live scan.

Question 2. Sickness report form are also held electronically and completed digitally. We are unable to print off this document but I can provide a 'screen dump'(an electronic copy was supplied)
