Whereabouts of a named individual

Request

I have been given to understand that an individual answering to the name of XXXXXXX was arrested by Cheshire Police on the 15th April.

Repeated enquiries by many concerned individuals have so far failed to ascertain where Mr xxxxx is being held and on what charges.

Until both these open questions are answered in a satisfactory manner, I together with an ever-widening circle of friends and acquaintances will feel compelled, as a matter of civic duty, to continue to pester you and thereby distract from your important and greatly valued task of protecting our community from real crime.

Response

In accordance with section 17 (4) of the Act our response is provided below;

The Cheshire Constabulary neither confirms nor denies that it holds any of the information requested. To give a statement of the reasons why neither confirming nor denying is appropriate in this case would itself involve disclosure of exempt information, therefore under s17(4), no explanation can be given. To the extent that section 40 (5) applies, the Cheshire Constabulary has determined that in all the circumstances of the case the public interest in maintaining the exclusion of the duty to neither confirm nor deny outweighs the public interest in confirming whether or not information is held.
