Please may i ask if Police Forces have an Auditing System in
place for any Audit Trail requests?
Response
In accordance with the Act our response is provided below;
The Cheshire Constabulary neither confirms nor denies that it
holds the information requested. To give a statement of the reasons
why neither confirming nor denying is appropriate in this case
would itself involve disclosure of exempt information, therefore
under section 17 (4), no explanation can be given. To the extent
that section 31(3) applies, the Cheshire Constabulary has
determined that in all the circumstances of the case the public
interest in maintaining the exclusion of the duty to neither
confirm nor deny outweighs the public interest in confirming
whether or not the information is held.
In determining where the public interest lies we have considered
the following factors:
In favour of disclosure are the general arguments in favour of
promoting transparency, accountability and participation.
In favour of maintaining the exclusion to confirm or deny are
arguments that to do so would disclose an important investigative
ability or the lack of it. There would be no beneficial impact on
the wider public. It is clear that the public interest would not be
served in confirming or denying this ability.
