- What type, make and models of all Speed detection Equipment
have been purchased and are currently in use with your Police
Force?
- What type, make and model of peripheral equipment has been
purchased and is in use with Speed Detection Devices used with your
Police Force?
- How many static fixed camera sites are there within your County
( Gatso etc )
- Are all of these Gatso Fixed static sites still fully
operational?
- How many Red Light Camera sites are there in your County?
- Are all of these Red Light Camera Sites still in
operation?
- Is it your Force Policy that in relation to the Operational use
of Speed Detection Equipment that all officers are instructed to
adhere to ACPO guidelines and Manufacturers Instructions?
- Do all persons trained in the use of Speed Detection devices
undergo periodic refresher training and if so how often?
- Is there records kept of this refresher training ?
- Does your Police Force employ civilian Speed Camera
operators?
- Since the 1st of January 2010 up to the 1st of February 2011,
could you please supply me with the figures / statistics in
relation to the following requests. ( Speeding Offences from Safety
Cameras only ).
- How many NIP's have been issued?
- How many have reverted to a Fixed Penalty Ticket ?
- How many have qualified for a Speed Awareness Course ?
- How many Speed Awareness Courses have been undertaken by
offenders ?
- How many drivers elected for a Court appearance?
- How many drivers were above the speed threshold for a Fixed
Penalty and were automatically summonsed ?
- How many offences were detected by Static Fixed Cameras.
(Gatso).
- How many offences were detected by the Mobile Safety Camera
Units ?
- How many Heavy goods vehicles have been detected by the Safety
Camera Unit and how many resulted in the issue of a NIP ?
- How many Light Goods Vehicles have been detected by the Safety
Camera Unit and how many resulted in the issue of a NIP.
- How many times have officers from the Safety Camera Unit
attended Court to give evidence in relation to Excess Speed or
related offences ?
- How many Foreign Force enquiries have been conducted ?
- How many Foreign Force enquiries have been issued by your
Police Force ?
Response
In accordance with section 1(1) (b) of the Act our response is
provided below;
From our preliminary assessment, we estimate that compliance
with your request would exceed the appropriate costs limit under
section 12 of the Freedom of information Act 2000. This is
currently £450. The reasons for this are primarily in relation to
questions regarding statistical information, most if not all would
require a manual search of records to extract the information. It
is estimated that the time would be well in excess of 80 hours.
This would exceed the appropriate limit.
Section 17 of the Freedom of Information Act 2000 requires the
Cheshire Constabulary, when refusing to provide such information
(because the information is exempt) to provide you with a notice
which a) states that fact, b) specifies the exemption in question
and c) states (if that would not otherwise be apparent) why the
exemption applies.
The appropriate limit is defined in the Data Protection and
Freedom of Information (Fees and Appropriate Limit) Regulations
2004, which is covered by statutory Instrument Number 3244 of 2004.
Furthermore, Section 12 of the Freedom of Information Act 2000
allows a public authority to refuse to respond to a request for
information where the cost of compliance would exceed the
appropriate limit as defined by the above mentioned
regulations.
