Request
With regard to my discussions with Staff Officer Steve Hopkins
at Warrington, please provide me a copy of the document relating to
incident 597 and the log book records for the 12th and 13th
February 2010, in conjunction with the raid on my home by Grampian
Police Officers.
It would also be helpful if you could provide me with a copy of
the warrant executed to authorise the raid, which has consistently
been withheld from me and two members of parliament. If the warrant
actually exists and is lawful, I see no reason why I cannot see
it.
Your prompt response would be appreciated, in order to avoid any
delay to legal process.
Response
In accordance with section 1(1) (a) of the Act our response is
provided below;
Section 17 of the Freedom of Information Act 2000 requires the
Cheshire Constabulary, when refusing to provide such information
(because the information is exempt) to provide you with a notice
which a) states that fact, b) specifies the exemption in question
and c) states (if that would not otherwise be apparent) why the
exemption applies.
The information you have requested is exempt by virtue of
section 40 (2) of the Act, personal data.
Section 40(1) any information to which a request for information
relates is exempt information if it constitutes personal data of
which the applicant is the data subject.
To obtain information relating to yourself you may wish to
consider applying under the Data Protection Act Section 7 Data
Subject rights.
Please find attached a 'Subject Access' application form for
your attention.

Please print the form and after completion, return it to the
address on the form, together with proof of identification, fee of
10 pounds sterling and for UK residents only, a stamped, self
addressed envelope to enable us to return your receipt for payment
and the document you send us as identification.
We accept either original identification documents or copies,
certified by a police officer or solicitor (e.g. driving licence,
passport, birth certificate, medical card, bank statement or
utility bill).
Replies can take up to six weeks to be returned to you from the
Criminal Records Office in Hampshire.
