Domestic Violence Murders

  • Reference Number: 3018
  • Date released: 04 April 2011

Request

I am attempting to get data on the number of domestic violence murders and, within that figure, the number in which it later became clear, previous incidents/attacks had occurred but not been reported to the police. Preferably within the last 5 years.

I would appreciate any advice on where this information may be available, or how an FOI could be structured to that effect,

I am hoping to find out the number of Domestic homicides ( killing, including murder, manslaughter and infanticide, by a member of a family, of another. Or by a current of former partner).

Within that figure, I would like to know how many of the accused/charged, had previous convictions of domestic violence (including Common assault, ABH, GBH, criminal damage, public order) against the homicide victim or previous partner/family member. Or if there were an injunctions/ non-molestation orders in place

Aware that you are busy and there is a sensible time limit on FOI requests, I would ask that this would be done for the year 2009-10 only.

Response

In accordance with section 1(1) (b) of the Act our response is provided below;

Domestic Homicides: Please see the attached Excel sheet:

FOI 3018 Domestic Homicides

With regard to the last part of your request, previous history of domestic violence for the year 2009/2010: We are unable to provide any further information as matters are in the court process and are sub judice. Therefore the Cheshire Constabulary can neither confirm nor deny that it holds any of the information requested. To give a statement of the reasons why neither confirming nor denying is appropriate in this case would in itself involve disclosure of exempt information, therefore under section 17(4) no explanation can be given. To the extent that section 44 applies, the Cheshire Constabulary has determined that in all the circumstances of the case the public interest in maintaining the exclusion of the duty to neither confirm nor deny outweighs the public interest in confirming whether of not the information is held.

(Section 44 relates information covered by Prohibition on Disclosure)
