Is your Force involved in issuing of ABCs either on its own or
in partnership(s)?
Does it hold any statistics on numbers of ABCs issued in the
Force area?
Please supply a copy of any standard letter issued to parents of
children where an ABC might be considered.
Has your Force sought legal opinion/advice concerning the
applicability of the Human Rights Act 1998 to the operation of ABCs
by your Force?
In particular has any regard been paid to the implications of
Article 6.1 of the Convention as regards your Force's involvement
with ABCs?
Response
In accordance with section 1(1) (a) of the Act our response is
provided below;
I refer you to or previous response to the same questions, which
although you have refined your request considerably I regret that
it still exceeds the cost threshold. The reasons were explained
previously. There is no centrally held information . This subject
is dealt with in the various crime and disorder partnerships
throughout the police area and there is no collation of figures.
The official response therefore is as follows:
Therefore, it is estimated this would exceed the appropriate
limit. The appropriate limit is defined in the Data Protection and
Freedom of Information (Fees and Appropriate Limit) Regulations
2004, which is covered by statutory Instrument Number 3244 of 2004.
Furthermore, Section 12 of the Freedom of Information Act 2000
allows a public authority to refuse to respond to a request for
information where the cost of compliance would exceed the
appropriate limit as defined by the above mentioned
regulations.
However what I have done is to circulate all the partnerships
asking if they would at least provide the overall numbers of ABC's.
I will let you have that figure as soon as I get it.
You asked for a copy of a 'standard letter' I don't think such a
thing exists as I understand that any contracts are individually
tailored to the person concerned and therefore are not
standard.
