Union Work

Request

Firstly I am interested in police staff and PCSOs working full time for a union. Can you please specify for each staff member or PCSO:

a.) The union they work for and if possible the role within the union

b.) Their salary band and, if possible, pay point

c.) Any expenses incurred as part of their union work; this includes, but is not limited to food, accommodation and transport.

Secondly for those police staff or PCSOs working part time for a union:  Can you specify for each staff member or PCSO:

a.) The proportion of their time they spend on union work – please state this as a percentage i.e. FTE full time equivalent.

b.) Their salary band and, if possible, pay point

c.) Any expenses incurred as part of their union work; this includes, but is not limited to food, accommodation and transport.

Response

In accordance with section 1(1) (b) of the Act our response is provided below;

PART A Full Time

a) 3 x full time Unison.- Branch Secretary, Assistant Branch Secretary & Admin. Assistant

b) The total salary amount is £90,369.

With reference to the salary band/pay point. I have considered this part of your request and I am not obliged to supply this information.

Section 17 of the Freedom of Information Act 2000 requires the Cheshire Constabulary, when refusing to provide such information (because the information is exempt) to provide you with a notice which a) states that fact, b) specifies the exemption in question and c) states (if that would not otherwise be apparent) why the exemption applies.

This information is exempt information in accordance with:

Section 40 (2) Personal Data

Section 40(2) relates to any information to which a request for information relates is also exempt information if

(a) it constitutes personal data which does not fall within subsection (1), and
(b) either the first or the second condition below is satisfied
(3) The first condition is:-

(a) in a case where the information falls within any of paragraphs (a) to (d) of the definition of "data" in section 1(1) of the Data Protection Act 1998, that the disclosure of the information to a member of the public otherwise than under this Act would contravene:-

(i) any of the data protection principles, In this case disclosure would breach Principles 1 & 2 of the Data Protection Act 1998 and would be unlawful

c) None

PART B Part Time

a) Currently 27 union stewards who undertake various union activities along side their full time substantive roles. The time spent on union duties is not calculated.

b) As b) above

c) No other costs are met by the Constabulary
