1) How many people have been charged with malicious
communication in the last three years?
2a) How many of those people have been charged with malicious
communication where there was a MI - internet, email, chatroom -
feature code in the past three years?
b)Can you please list the date of the charge and as much detail
as is possible (i.e what was written on the internet etc, were they
found guilty etc)
Response
In accordance with section 1(1) (a) of the Act our response is
provided below;
1) We can found no record of persons being charged under the
Malicious Communications Act 1988
2a & b N/A
In addition the Cheshire Constabulary can neither confirm nor
deny that it holds any other information in relation to your
request. To give a statement of the reasons why neither confirming
nor denying is appropriate in this case would itself involve
disclosure of exempt information, therefore under section 17 (4),
no explanation can be given. To the extent that section 23 (5)
applies, the Cheshire Constabulary has determined that in all the
circumstances of the case the public interest in maintaining the
exclusion of the duty to neither confirm nor deny outweighs the
public interest in confirming whether of not any other information
is held.
