There is a Memorandum of Understanding (MOU) in place between The National Police Chief’s Council (NPCC) and the Association of British Insurers (ABI) to facilitate partnership working between the Police Service and the Association of British Insurers.
Cheshire Constabulary will consider request for disclosure made in accordance with the NPCC-ABI-MOU. This applies only to ABI members or eligible third parties acting on behalf of an ABI member.
Request from ABI members must be made on the relevant Appendix Form. The form must be completed in full.
The form must specifically state exactly why each piece of information requested is necessary.
Where an eligible third party makes an information request on behalf of an ABI member, they must provide the name of the ABI member Insurer for whom they are acting on the relevant request form.
A response from Cheshire Constabulary will only be made to the ABI member therefore the form must include the email address for the ABI member that disclosure should be made to.
If an email address for the ABI member is not included a disclosure will not be made and a refund will not be available.
Cheshire Constabulary currently do not accept request from non-ABI members unless they are an eligible third party acting on behalf of an ABI member.
If you do not qualify via the NPCC-ABI-MOU please refrain from making a request to Cheshire Constabulary as the request will be refused.
Cheshire Constabulary will not disclose if information relates to an ongoing investigation unless the Officer in the case (OIC) can confirm that no prejudice will be caused by the release.
The disclosure will be redacted to ensure compliance with data protection legislation.
When a request for information is accepted via the NPCC-ABI-MOU Cheshire Constabulary will only make one disclosure of the requested information, duplicate copies will not be provided.
Please do not make payment until you have contacted the Requests Team with a completed Appendix D(a) form. At this point we will provide you with details of how to make payment and provide you with a reference number to use to make your payment.
For details on how to make payment you should submit an Appendix D(a) form to us via email to [email protected]
Please be aware that as per the National Policing Guidelines on Charging for Police Services the fee is payable to ‘request disclosure of information held by the police’. Making payment does not guarantee that information is held or can be disclosed. If there is no information held or if a disclosure cannot be made due to data protection legislation or due to there being an ongoing case the fee cannot be refunded.
Subject access is not the correct avenue to request information for the purpose of an insurance claim.
When a request is made via subject access for information relating to an insurance claim this could be considered as an ‘enforced’ subject access request (SAR). The ICO confirm that 'Forcing an individual to make a SAR in such circumstances is a criminal offence." this is confirmed in section 184 of the Data Protection Act.
